The action is one to recover damages for personal injuries sustained in a collision between automobiles. The plaintiff was a guest in one of the automobiles. Defendant Clarence Strack is the host-driver. The other defendants are the trustees of an estate which is the employer of one Flodeen, the driver of the other car. The trustees moved for summary judgment dismissing the action as to them and the trust estate. The trial court denied the motion and the trustees have appealed.
